Terms of Service
Last updated: 28 September 2026
1. About these terms
These terms apply when you use the Freaking Minds website, send us an enquiry, enrol in an FM Academy programme, apply to the CreativeMinds talent network or use one of our portals. “We”, “us” and “our” mean Freaking Minds, based in Bhopal, Madhya Pradesh, India. By using the site or any of these services, you agree to these terms. If you don’t agree, please don’t use them.
Our Privacy Policy explains how we handle your personal data, and forms part of these terms.
2. Using the site
You can browse the site, read our work and articles, and contact us, for your own personal or business use. The information on the site is general. It describes what we do, but it isn’t an offer to do a particular piece of work at a particular price, and it isn’t professional advice for your situation.
We try to keep the site accurate and available, but we may change, suspend or remove any part of it at any time.
3. Working with us
Sending an enquiry, taking the scorecard or booking a call doesn’t create a contract for services. When we agree to work together, the scope, deliverables, timelines, fees, payment terms, ownership of the work and how either of us can end the engagement are set out in a separate proposal, contract or statement of work. That document governs the engagement, and if it conflicts with these terms, it wins.
When you send us material to use in your project, you confirm that you have the right to let us use it, and that it doesn’t infringe anyone else’s rights.
4. FM Academy: enrolment and payment
- Prices are shown in Indian rupees on each programme page, and Indian GST applies. The price you pay is the one that applies when you start checkout, including any early-bird price that is still open at that time.
- You pay through Razorpay, and Razorpay issues the receipt. Your payment details go to Razorpay, not to us, and Razorpay’s own terms apply to the payment.
- Your seat is booked only once your payment succeeds. Starting checkout doesn’t hold a seat, and seats are limited, so a programme can sell out while your payment is pending.
- If you start checkout but don’t finish paying, we may send you one reminder email with a link to complete your booking.
- When your payment is confirmed, we email you a confirmation with the joining details.
- Your seat is for you. Please don’t share access to the programme or its materials with anyone who hasn’t enrolled.
5. FM Academy: refunds and changes
Refunds. If a programme isn’t the right fit for you, you can have a full refund if you ask within the first 3 days of the programme. To ask for one, email freakingmindsdigital@gmail.com with the name and email address you enrolled with. Refunds go back to your original payment method through Razorpay. If a programme page states a different refund rule, the rule on that page applies to that programme.
If we change or cancel a programme. We may need to change a programme’s dates, schedule, venue, format or instructors. If we do, we will tell you as early as we can. If we cancel a programme, or change its dates so that you can no longer attend, we will offer you a place on a later batch or a full refund.
Completion. Where a programme offers a certificate, it is given to participants who complete the programme.
Nothing in this section affects any rights you have under the Consumer Protection Act, 2019.
6. CreativeMinds applications
When you apply to the CreativeMinds talent network, you give us permission to store your application, review it and the work you link to, and share it within our team to assess it. If you are accepted, you also give us permission to publish your profile page and to show your profile and linked work to clients when proposing you for projects. You can edit your profile from the talent portal, or ask us to remove it at any time.
You confirm that the details you give us are accurate and that the work you link to is yours, or that you are entitled to show it. You keep ownership of your work. Applying doesn’t guarantee acceptance, and being accepted doesn’t guarantee any amount of work. The terms of any project you take on, including pay, are agreed separately for that project.
7. Portals and accounts
If we give you access to the client portal, the talent portal or our team tools, keep your sign-in details to yourself and let us know straight away if you think someone else has used them. You are responsible for what happens under your account. We may suspend access if an account is misused, or when the engagement or membership it relates to ends.
8. Intellectual property
The content of this site — including text, design, graphics, logos, video and code — belongs to Freaking Minds or to the people who licensed it to us. You may view it and share links to it, but you may not copy, republish or reuse it commercially without our written permission.
Ownership of work we create for clients is set out in the contract for that engagement. Unless that contract says otherwise, we keep the right to show the work in our portfolio, and we keep ownership of the tools, templates and methods we use to deliver it.
FM Academy course materials are for your own learning. You may not resell, republish or share them.
9. Acceptable use
When you use the site, our forms, the chat assistant, our WhatsApp number or the portals, you must not:
- break the law, or help anyone else to;
- send false information, or pretend to be someone else;
- send spam, or submit forms automatically or in bulk;
- try to get into parts of the site, accounts or data you aren’t authorised to access;
- interfere with the site’s security or performance, including by uploading malicious code or overloading it;
- scrape or harvest content or personal data from the site;
- send anything abusive, defamatory, obscene, or that infringes someone else’s rights.
We may block submissions, messages or access that break these rules.
10. Third-party services
Parts of the site rely on other companies’ services, such as Razorpay for payments, Cal.com for bookings, WhatsApp for messaging and the chat assistant on our public pages, and the site links to other websites. Those services and sites have their own terms, and we aren’t responsible for their content or for how they work.
11. Disclaimers
We work hard to get results, but marketing outcomes depend on many things outside our control, so we don’t guarantee particular results such as search rankings, follower numbers, leads, sales or revenue, unless a contract with you says so. Likewise, FM Academy teaches skills; it doesn’t guarantee a job, clients or income.
Case studies, figures and examples on the site describe past work. They aren’t a promise of what we will achieve for you. Apart from what we have agreed in a contract with you, the site and its content are provided “as is”.
12. Limitation of liability
As far as the law allows, we aren’t liable for any indirect or consequential loss, or for loss of profit, revenue, data or business opportunity, arising from your use of the site or our services. Our total liability to you for any claim is limited to the amount you paid us for the specific service or Academy seat the claim relates to.
Nothing in these terms limits liability that the law doesn’t allow us to limit, such as liability for fraud.
13. Governing law and disputes
These terms are governed by the laws of India. If a dispute comes up, please contact us first and we will try to resolve it with you directly. If we can’t, the courts at Bhopal, Madhya Pradesh, India have exclusive jurisdiction.
14. Changes to these terms
We may update these terms from time to time and will change the “Last updated” date at the top when we do. Changes apply from the date they are posted, and don’t affect an Academy seat you have already paid for or a contract you have already signed. If you keep using the site after a change, you accept the updated terms.
